1. Acceptance of Terms

By accessing or using the Art by Docswan website, you agree to be bound by these Terms and Conditions in full. If you do not agree with any part of these terms, you must not use this website.

2. Use of Website

    •    You may view, download, and print content from this website for your personal, non-commercial use only.

    •    You must not reproduce, duplicate, copy, sell, resell, or exploit any material on this website for commercial purposes without express written permission from Art by Docswan.

3. Intellectual Property

    •    All artwork, images, text, and other content on this website are the intellectual property of Art by Docswan unless otherwise stated.

    •    You may not republish, distribute, or modify any content from this site without prior written consent.

    •    By purchasing or commissioning artwork, you receive ownership of the physical piece, but not the copyright or rights to reproduce the artwork unless explicitly agreed upon in writing.

4. Commissions

    •    Commissioned work requires clear communication regarding requirements, deadlines, and pricing before work begins.

    •    A non-refundable deposit (typically 50%) is required to start a commission; the balance is due upon completion, prior to delivery.

    •    The artist retains the right to refuse commissions at their discretion.

    •    Minor revisions may be requested during the sketch stage; significant changes after approval may incur additional fees.

    •    The artist retains the right to display commissioned works in portfolios, online galleries, and social media unless otherwise agreed.

5. Listings and Transactions

    •    All artwork listings must be accurate and complete. The seller is solely responsible for the accuracy of listings.

    •    Transactions are conducted directly between buyer and seller. Art by Docswan is not liable for any disputes, damages, or losses resulting from transactions.

    •    Prices are listed in U.S. dollars and do not include taxes, shipping, or handling fees unless specified.

6. Shipping, Delivery, Returns, and Refunds

    •    Shipping costs and delivery times will be clearly stated before purchase. The seller is responsible for safe packaging and accurate delivery information.

    •    The risk of loss passes to the buyer upon shipment.

    •    Returns and refunds are handled on a case-by-case basis; custom or commissioned works are generally non-refundable unless damaged in transit.

7. User Conduct

    •    Users must not use the website for unlawful purposes or in a way that may damage, disable, or impair the site.

    •    Abusive, fraudulent, or otherwise inappropriate conduct may result in termination of access.

8. Indemnification

You agree to indemnify and hold harmless Art by Docswan from any claims, damages, or liabilities arising from your use of the website or breach of these terms.

9. Modifications

Art by Docswan reserves the right to modify these Terms and Conditions at any time. Changes are effective immediately upon posting. Continued use of the website constitutes acceptance of the updated terms.

10. Governing Law

These Terms and Conditions are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.
